An Idea
You know I think I got an answer, but I'm not really sure?
If we could limit the "sharia expert" jurisdiction to rule on questions that pertain purely to religion, and limit the "law experts" jurisdiction to questions that pertain purely to the state. Some system to set jurisdiction
We would also have to give the legislature the power to set or override a question of jurisdiction that would arise between the two courts, or if the people did not like or could not accept the result of a dispute between the two courts and the legislature, by a super majority of the representatives, and or legislative cycles, and or referendums by the people. Or some mix there of.
Then I think a constitution like the Iraqi draft might pass muster. It's not so much to ask, to split the jurisdiction, and make explicit in this document that the people hold absolute power on all questions and have a built-in, fair, system available to effect any change they deem necessary.
There is an easier fix, but they seem to want complication.
