Judge Throws Out Statements in Detainee Death

A military judge ruled that statements given by a Fort Campbell soldier implicating himself and another soldier in the death of an Iraqi detainee cannot be used in the upcoming trial.

The Kentucky New Era reported that Col. Theodore Dixon threw out the statements during a hearing Wednesday because Staff Sgt. Hal Warner was questioned prior to being read his rights.

Warner and 1st Lt. Michael Behenna, both assigned to the 101st Airborne Division, are charged in the May death of detainee Ali Mansour Mohammed in Iraq.

Warner has pleaded not guilty to premeditated murder, accessory to murder, assault, obstruction of justice and making a false official statement. His court-martial is scheduled for Feb. 16.

Behenna was charged with premeditated murder, assault and making a false statement, but has not yet entered a plea.
